Terms of Use

1. General Provisions

1.1. These terms of use (hereinafter - "Terms") are a binding legal document establishing the rights and obligations of the User and the Service Provider, the conditions for service provision and payment, subscription procedures, liability of the parties, and other provisions related to the use of the FoodScan.ai service.

1.2. The FoodScan.ai service (hereinafter - "Service") is provided by MB "Tumas AI" (hereinafter - "Service Provider", "we").

1.3. The Service is accessible via the website foodscan.ai and the Telegram bot.

1.4. By starting to use the Service and creating an account, the User confirms that they have read these Terms and agree to comply with them.

2. Service Description

2.1. FoodScan.ai is an artificial intelligence-based food product analysis service that:

  • Analyses food product labels based on photos sent by the user
  • Provides information about ingredients, nutritional value, and potential health impact
  • Offers the ability to interact with an AI assistant about nutrition and food products

2.2. AI-generated analysis is informational in nature and should not be considered medical, nutritional, or other professional advice. We recommend consulting a qualified specialist before changing dietary habits or making health-related decisions.

3. Registration and Account

3.1. To use the Service, it is necessary to create an account by providing an email address and confirming it with a verification code.

3.2. The User must provide a valid and correct email address.

3.3. The User is responsible for the security and confidentiality of their account.

3.4. The User may voluntarily supplement their profile with personal information (age, weight, height, goals), which is used to personalise analyses.

4. Plans and Subscriptions

4.1. Free Plan (Basic)

  • Limited number of scans per day
  • Limited number of messages per day
  • Additional free scans are granted upon registration

4.2. Premium Plan

  • Unlimited scans
  • Unlimited messages
  • The subscription is valid for the selected period (monthly, half-yearly, or yearly)
  • When the subscription expires, Premium features become unavailable and the User reverts to the free plan

4.3. Pricing and Payments

  • All prices are quoted in euros and include VAT (where applicable)
  • Payments are processed through the Stripe platform
  • We do not store payment card details
  • Prices may change; we will inform you in advance of any changes

5. Subscription Cancellation and Refunds

5.1. The User may cancel their Premium subscription at any time.

5.2. Upon cancellation, Premium features remain available until the end of the current subscription period.

5.3. Refunds are not provided for subscription periods that have already been paid for and activated, as the digital service has been commenced.

5.4. The User agrees to the commencement of the digital service and is informed about the loss of the right of withdrawal in accordance with applicable consumer protection legislation.

6. User Rights and Obligations

6.1. The User undertakes to:

  • Use the Service honestly and without infringing third-party rights
  • Not send illegal, offensive, or harmful content
  • Not attempt to compromise the security or stability of the Service
  • Not send photos unrelated to food products
  • Comply with these Terms and applicable laws

6.2. The User has the right to:

  • Use the Service according to the conditions of their selected plan
  • Update their profile data at any time
  • Delete their account and all associated data at any time
  • Contact the Service Provider regarding questions or issues

7. Service Provider Rights and Obligations

7.1. The Service Provider undertakes to:

  • Provide the Service according to the conditions set out in these Terms
  • Protect User personal data in accordance with the Privacy Policy
  • Inform about significant changes to the Service or Terms

7.2. The Service Provider has the right to:

  • Restrict or suspend User access to the Service if the User violates these Terms
  • Temporarily suspend the Service for maintenance or updates
  • Modify Service functionality, plans, and pricing
  • Unilaterally amend these Terms

8. Intellectual Property

8.1. All Service software, design, content, and trademarks belong to MB "Tumas AI" or are used under licence.

8.2. The User does not acquire any intellectual property rights to the Service or its content.

8.3. AI-generated analysis results are provided to the User for personal use. Mass copying, distribution, or commercial use without written consent of the Service Provider is prohibited.

9. Limitation of Liability

9.1. The Service is provided on an "as is" basis.

9.2. The Service Provider does not guarantee that:

  • The Service will operate without interruptions or errors
  • AI analysis results will be completely accurate or comprehensive
  • The Service will meet all User expectations

9.3. AI analysis results are informational in nature. The Service Provider is not liable for decisions made based on AI-provided information.

9.4. The Service Provider is not liable for damage caused by:

  • Incorrect data provided by the User
  • Disruptions to third-party services (Stripe, Telegram)
  • Force majeure circumstances

10. Account Deletion

10.1. The User may delete their account at any time through profile settings.

10.2. Upon account deletion, all associated data (profile, conversation history, photos) will be irreversibly removed.

10.3. Payment data may be retained longer in accordance with accounting requirements.

11. Dispute Resolution

11.1. These Terms are governed by the laws of the Republic of Lithuania.

11.2. All disputes shall be resolved through negotiation. If an agreement cannot be reached, disputes shall be resolved in accordance with applicable law.

11.3. The User may also use the European Online Dispute Resolution platform: https://ec.europa.eu/odr

12. Changes to Terms

12.1. The Service Provider may unilaterally amend these Terms.

12.2. Users will be informed of significant changes by email and/or Service notification.

12.3. Continued use of the Service after the Terms have been amended constitutes the User's acceptance of the new version of the Terms.
